Welcome to RareCustom ("we," "our," or "us"). By accessing, browsing, or using our website (rarecustom.com) and services, you ("you" or "user") agree to be bound by these Terms of Service ("Terms"), our Privacy Policy, and all applicable laws and regulations. If you do not agree with any of these Terms, you must not use our services.

We reserve the right to update or modify these Terms at any time. Your continued use of our services after changes constitutes acceptance of the modified Terms.

RareCustom provides custom merchandise design and production services, including:

• Online design tools for creating custom merchandise
• Custom printing (DTG, screen print, sublimation), embroidery, and engraving services
• Production and delivery of personalized products
• Account management, design storage, and order tracking

We strive for accuracy in all product descriptions, pricing, and imagery. However, we do not warrant that descriptions, pricing, or other content is accurate, complete, reliable, or error-free. Colors may vary slightly between screens and printed products.

To use certain features, you must create an account. By registering, you agree to:

• Be at least 18 years of age or have parental/guardian consent
• Provide accurate, current, and complete registration information
• Maintain the security of your account credentials and not share them
• Notify us immediately of any unauthorized access to your account
• Accept responsibility for all activities that occur under your account

We reserve the right to suspend or terminate accounts that violate these Terms or appear to be fraudulent.

Custom merchandise orders are subject to the following policies:

• Design Proof: You will receive a design proof for review before production begins. You are responsible for reviewing and approving the proof. Once approved, changes cannot be made.
• Production Time: Standard production is 2-5 business days depending on product type. Rush production is available for an additional fee (see Shipping Info).
• Color Accuracy: Colors may vary slightly from on-screen mockups due to screen calibration, printing processes, and material differences. Minor variations are expected and not considered defects.
• Artwork Quality: We require high-resolution artwork (minimum 300 DPI). Low-quality images may result in pixelated or blurry prints. We will notify you if your artwork does not meet quality requirements.
• Custom Orders Are Final: Due to the personalized nature of our products, approved custom orders are non-refundable for design preference reasons (changed mind, wrong color choice). See our Returns Policy for defect claims.

All designs submitted for production are subject to our content review process. Designs are evaluated as follows:

We reserve the right to refuse any design that violates these standards or our policies. If a design is rejected, you will be notified and offered options to modify or cancel.

Your Content

You retain all rights to artwork, designs, and content you upload to our platform. By uploading content, you represent and warrant that:

• You own or have the necessary rights, licenses, or permissions to use the content
• The content does not infringe on any third-party intellectual property rights
• The content does not violate any applicable laws or regulations
• You grant us a limited, non-exclusive license to use your content solely for producing and fulfilling your custom orders and displaying design previews in your account

Our Content

All content on our website, including logos, templates, designs, text, graphics, software, and the design tool itself, is the property of RareCustom and protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

We respect intellectual property rights and comply with the Digital Millennium Copyright Act (DMCA). If you believe content on our site infringes your copyright, you may submit a DMCA takedown notice to our designated agent:

Your notice must include:

• Identification of the copyrighted work claimed to be infringed
• Identification of the material on our site that you claim is infringing, with enough detail for us to locate it
• Your contact information (name, address, phone, email)
• A statement that you have a good-faith belief that use of the material is not authorized
• A statement, under penalty of perjury, that the information is accurate and that you are authorized to act on behalf of the copyright owner
• Your physical or electronic signature

Counter-notification: If you believe your content was wrongly removed, you may file a counter-notification with the same agent. We will process counter-notifications in accordance with the DMCA.

• All prices are in United States Dollars (USD) and subject to change without notice
• Payment is required at the time of order placement
• We accept major credit cards, debit cards, and other payment methods as displayed at checkout
• You authorize us to charge your payment method for all fees incurred, including product costs, shipping, and applicable taxes
• We reserve the right to refuse, cancel, or modify orders at our discretion, including for suspected fraud or pricing errors
• Pricing errors: If an error occurs, we will notify you and give you the option to cancel or proceed at the correct price
• Promotional codes: Discount codes are subject to specific terms, may have expiration dates, and cannot be combined unless explicitly stated

• Standard shipping is free on every order within the contiguous United States
• Expedited and rush shipping options are available at additional cost
• International shipping is available; costs are calculated at checkout based on destination
• Delivery times are estimates and may vary due to carrier delays, weather, or other factors
• Risk of loss passes to you upon delivery to the carrier
• You are responsible for providing accurate and complete shipping information
• Customs duties and import taxes on international orders are the responsibility of the recipient

You agree not to:

• Use our services for any unlawful purpose or in violation of any applicable law
• Upload designs that infringe on intellectual property rights of others
• Upload or transmit malicious code, viruses, or attempt to breach security
• Impersonate any person or entity or misrepresent your affiliation
• Interfere with or disrupt our services, servers, or networks
• Collect or harvest information about other users without consent
• Use automated systems (bots, scrapers) to access our website without permission
• Attempt to reverse-engineer, decompile, or disassemble our design tool or software
• Resell or commercially exploit our services without written authorization

You agree to indemnify, defend, and hold harmless RareCustom, its officers, directors, employees, agents, licensors, and suppliers from and against all claims, losses, expenses, damages, and costs (including reasonable attorneys' fees) arising from:

• Your use of or access to our services
• Your violation of these Terms
• Your violation of any third-party rights, including intellectual property rights
• Content you upload, submit, or transmit through our services
• Any claim that your content caused damage to a third party

This indemnification obligation survives the termination of these Terms and your use of our services.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, RARECUSTOM SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, goodwill, or use
• Damages resulting from your use or inability to use our services
• Errors or inaccuracies in content or product descriptions
• Unauthorized access to or alteration of your transmissions or data
• Third-party conduct or content on our website
• Shipping delays or loss by carriers beyond our control

OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR OUR SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE SPECIFIC PRODUCT OR SERVICE GIVING RISE TO THE CLAIM DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT OUR SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT DEFECTS WILL BE CORRECTED.

Governing Law: These Terms are governed by the laws of the State of Arizona, United States, without regard to conflict of law provisions.

Informal Resolution: Before filing a formal dispute, you agree to contact us at [email protected] to attempt to resolve the matter informally. We will work to resolve your concern within 30 days.

Binding Arbitration: If informal resolution fails, any dispute arising from these Terms or your use of our services shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration shall take place in Phoenix, Arizona, or may be conducted remotely.

Class Action Waiver: YOU AND RARECUSTOM AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. Unless both parties agree otherwise, the arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding.

Exceptions: Either party may bring claims in small claims court if the dispute qualifies. Either party may seek injunctive or equitable relief in a court of competent jurisdiction for intellectual property infringement.
